I got a lawyer who told me not much you can do about getting more from them for the truck but can go after them for "injuries" which we did and I made out OK in the end. If you don't have a lawyer I would get one NOW. If you are depeneding on the insurance co. or the woman that caused the accident to watch out for YOU....well maybe Santa will leave you the money if you are a real good boy.

$750 for a Bicycle !? Damn you could by an old truck or car for that much money.I bought Joanne a nice bike at auction while back for $10.Have to admit I never could understand why people even ride bikes in traffic other then they don't have a car. I've almost hit a couple myself over the years who ride out in the road going 20 MPH.....Todd

My bike by the way is a mid-eighties steel frame Trek 720. Not near as expensive as yours I'm sure but we have been together for a long time. I would be very unhappy if something happened to it.

It did not take long for the insurance company to settle with the threat of medical damages hanging over them. I don't aim to cheat the insurance but each time I have had the exact same problem as Todd, they will not pay replacement cost and that is not fair just because I drive a good, but old car.

Steve, threaten a medical claim. It is your only leverage.

I can sympathize... I ride an all-carbon bike that cost more than 4k new and I would be really bummed if anything happened to it because for me it's irreplaceable. I got it for much less than retail, slightly used.

In case the insurance doesn't come through and you get stuck with the repairs, I have a spare Italian fork, old style, that may work for you, free for the asking. It came off my '84 Basso (spare bike) when I upgraded.

First off, ditto what Bob said, "glad you're OK". If you haven't, you should still get looked at by a doc. There are a lot of injuries that only show up after a few days or so.

Anyway, here my story and advice; Back in 1999 my creampuff '83 Accord got rear ended. Road was wet and LOML was slowing down (from 25 mph) for some high school kids entering a crosswalk. The wheels of the car behind her (also 25 mph) locked up and as they say, the rest was history. Not really much damage, but age, miles and that *perfect patina* I spent years developing resulted in the price of one tail lamp lens being above the value of the car. I was offered $100.

I had several for sale adds, like Todd, showing very similar vintage cars (Toyotas, Nissans) with similar miles (175K) and condition being had for $1200 to $1700. I ended up with $1200, and I did it by *NOT* accepting what they had to offer and putting the ball back in their lap.

I can only share two pieces of advice with you (and everyone); the first is if you're not satisfied, don't accept their offer. The second and more important IMHO, is to *NOT* fill in the resulting silence with counter offers (at least right away). Please understand that this doesn't work for asking for the world, only for a reasonable (to you) settlement.

Be prepared to educate them on the value and uses of a bicycling. Unfortunately most people today still see 'riding a bike' only as a child�s activity. Dig out the receipt that shows planes that the bike 'bought'. Tell them that it is your normal mode of transportation. Point out that you�re trying to be reasonable and haven�t required temp transportation. Don�t hesitate to ask for their supervisor. Some of the arguments I used:

"Remember, it was your client that hit me."

"I wasn't in the market to buy a new car, but you're client forced that on me."

"I'm not looking to upgrade, just replace with a similar vehicle. Here's what they cost in my area �"

"If it's too much ($) then you can find me a replacement vehicle�

and my most used phrase:

�That�s unacceptable.�

In the end I got $1100 from his insurance and drove the car to the auto junk yard for $100. Good luck with your bike.

To keep this post on charter :o) OT used were my telephone. Big round rotary dial and a plug with four big brass prongs sticking out the back of it. In fact, the �phone number� tag in the center of the dial is still a word and five numbers.

That may be what the guy said, but unless you live in an odd state with very very odd law, the owner is responsible.

Most states have a version of "leash law" (I know of no states that do not, but there may be one hiding somewhere). Leash laws are absolutely clear on this point: if an injured person was on public property and an unleashed dog did the damage, the dog's owner is liable. Period. The leash law is a form of what we scum of the earth call "strict liability."

You might want to tell your motorhead pal to see an attorney. That dog's owner needs to be educated.

Then they cried. They had tried to offer her "a brand new Huffy" to replace her trashed bike. She didn't take it. She didn't even have to threaten legal action; all she did was mention to the adjuster that she was an attorny and they payed everything without an argument. Gotta love that profession at times... In any case, it never hurts to ask her insurance for full replacement costs, just be certain to have a signed itemized estimate from the bike shop/mechanic to prove you aren't trying to bilk them.

I had to do the same thing for a custom Titanium frame and high end wheel set...total cost of the bike, as built, was a touch over $5K....frame, forks, wheels all toast...they (insurance guys) looked at the bike and said it was scratched and would pay for a new set of rims...long story short, I ended up with a settlement that still put me out of pocket some for the rebuild, but it was better than the $250 they were trying to give me. I, like you, had a great lady to deal with, but insurance, just doesn't get high end bikes....Hold out, be patient and only accept what you think is fair.
