The foregoing is perfectly true. The problem is that folks can and do honestly disagree about whether contact has been made. My more legal type opinion is that the government has made a sufficient case that contact is being made and that regulations drawn to reduce the damages will be upheld. Lost productivity, workman's comp, and medical bills are all things that impact us, however diffuse those impacts may be for each of us on an individual basis.

My personal opinion is that Darwinian solutions to safety problems do not generally make for good public policy. Recall that lead is pretty useful in gasoline and paint.
